Terms & Conditions

In these Terms & Conditions, the following definitions apply:

• Tota — Tota B.V. and the digital Platform operated by it, trading under the name TotaMatch.
• Professional — A natural person (also referred to as Candidate or Job Seeker) who independently registers on the Platform for the purpose of finding assignments or employment. A Professional may also act as a Freelancer.
• Company — A business, employer or commercial client that uses the Platform to find and engage Professionals.
• Portal — The digital Platform of Tota, consisting of an online environment, database, network and system through which users can connect.
• JobPortal — The section of the Portal where Professionals can (anonymously) view Job Posts.
• ProPortal — The section of the Portal where Companies can (anonymously) view Professionals.
• Job Post — A vacancy or assignment posted on the Platform by a Company.
• Tota Selections — AI-generated selections and shortlists of Professionals and Job Posts created by Tota.
• Personal Selections — Professionals manually selected by Companies and linked to specific Job Posts.
• Tota List — The status indicating that a Professional or Job Post is available for a Match Request.
• Match Request — A request that allows a user to invite another party to initiate contact, whereby (partially) profile or vacancy information is disclosed.
• Match Acceptance — The acceptance of a Match Request by the receiving party.
• Tota Match — The situation that arises once a Match Request has been accepted.
• Tota Chat — The chat functionality that becomes available after a Tota Match.
• Tota Tokens — The digital currency of Tota, intended for Companies, stored in a Token Wallet and used for functionalities within the Platform.

2.1 Tota provides a Personal AI Recruiter in the form of a technical Platform that enables Companies and Professionals to connect.

2.2 Tota does not act as an intermediary, recruiter, employment agency, employer or contractor.

2.3 Tota does not make decisions regarding selection, placement, hiring or cooperation.

2.4 All agreements and arrangements are entered into directly between users.

2.5 Tota provides no guarantees regarding:

• Matches
• employment relationships
• assignments
• income
• availability

3.1 The Platform consists of multiple environments, including:

• JobPortal
• ProPortal

3.2 Professionals and Companies operate primarily anonymously within the Platform.

3.3 Profiles and Job Posts become (partially) visible only through interaction via the matching process.

4.1 Tota facilitates Matches through:

• Tota Selections (AI-driven)
• Personal Selections (manual)

4.2 A Match is established exclusively through the following process:

• Match Request
• Match Acceptance
• Tota Match

4.3 Communication is only enabled via Tota Chat after a Tota Match has been established.

4.4 Tota does not determine which parties should cooperate and does not provide binding recommendations.

5.1 Companies

• May post Job Posts
• May select and approach Professionals via Match Requests
• Are fully responsible for: selection, evaluation, contracting, and compliance with applicable laws

5.2 Professionals

• May register and create profiles
• May view Job Posts
• May accept or decline Match Requests

5.3 General

• Use is limited to individuals aged 18 years or older
• Users are responsible for the accuracy of their information
• Discrimination is not permitted
• Misconduct, including but not limited to abusive language, harassment, intimidation or other inappropriate behaviour, is not permitted

5.4 Tota reserves the right to suspend, block or remove user accounts in case of violation of these Terms or if deemed necessary by Tota.

6.1 Certain functionalities require the use of Tota Tokens.

6.2 Tota Tokens can be purchased online and are managed in a Token Wallet.

6.3 Tota reserves the right to modify pricing, token usage and functionalities.

6.4 Tota may annually index its prices.

6.5 Tota may apply discounts, promotions or custom pricing at its discretion.

7.1 Tota may offer additional services via the Platform, including but not limited to:

• digital interviews
• background screenings
• identity verification
• other assessment or verification services

7.2 These services are provided by third parties.

7.3 Tota acts solely as a facilitator and is not responsible for:

• execution
• quality
• outcomes
• any resulting damages

7.4 Use of these services is entirely at the user’s own risk.

All intellectual property rights related to the Platform remain with Tota.

The Platform is provided “as is”. Tota is not liable for Matches, interactions, agreements or user behaviour.

Users indemnify Tota against third-party claims.

Tota is not liable for failures due to force majeure.

Dutch law applies. Disputes are submitted to the court in Rotterdam.
